18 U.S.C. § 2257 Statement

All models, actors, actresses and other persons that appear in any photograph or video, whether of actual or simulated sexual acts or otherwise, that is available on the website were eighteen years old or over at the time of the creation of such.

Exemption: Content Produced by Third Parties

For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content showing explicit sexual activity, real or simulated, accessible on the website. The undertakings of owners and operators of the website are limited to the transmission, storage, retrieval, hosting, or formatting of content, which may be sexually explicit, that is contributed by third-party users. All user-provided content appearing on fapshots.com results from the actions of third-party users, who have control of areas of the website that contain the content. The operators of fapshots.com are therefore absolved from compliance with Section 2257 records keeping and labeling obligations as described in 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may remove any materials if such are determined, at the sole discretion of the operator, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.

Exemption: Content Produced by Website Operator

Any visual depictions that may appear on the website, for which the operator of the website may be considered the “producer,” are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not show any sexually explicit conduct as laid out in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not show depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not show simulated sexually explicit conduct; or (4) the images or videos were shot before July 3, 1995.

Designated Records Custodian

The operator of the website has appointed a custodian to be the keeper of original records as necessitated by 18 U.S.C. § 2257 and 28 C.F.R. Part 75. The records are in the care of said custodian and can be examined by sending a request through our admin [@] fapshots.com.
